We assist with contracts for purchase and sale of real estate, closings on residential and commercial properties, preparation and review of lease agreements, mortgage deeds and notes, as well as escrow agreements. We can assist you with the title review, the due diligence, and all the other aspects of your deal to bring to about a successful closing of your transaction.
In most cases, we provide legal guidance for individuals relating to the purchase or sale of real property. We ensures the transfer is legal, binding and in the best interest of our clients. During the purchase of a property, our staff often prepare all closing documents, we write title insurance policies, complete title searches on the property and handle the transfer of funds for the purchase. We prepare forms such as the HUD-1 Form and related transfer of funds documentation for the buyer’s lender (if the purchase is being financed).
Some of the most common transactions include:
- Purchase and Sale Agreements – We can prepare and review purchase and sale agreements on behalf of buyers and sellers. Getting this initial document correct is essential to having a solid start to a real estate transaction. We encourage our clients to get us involved as quickly as possible so we can head off any initial issues.
- Title Review and Insurance – as a purchaser or lender, you have to know what it is you are purchasing or taking as collateral. A review of title or a title insurance commitment is essential for this purpose. The seller/borrower may own the property but it may be subject to easements, restrictions or reservations which affect the use intended. The review and understanding of these title documents take an attorney experienced in handling real estate transactions.
- Survey review – typically, title insurance commitments and policies contain an exception for matters disclosed by an accurate survey. This requires a careful review of the survey to ensure that there are no additional title issues raised by it.
